Terms of Service

1. Acceptance of Terms

By accessing or using PlateWeek (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. “We,” “us,” and “our” refer to the operator of PlateWeek. “You” refers to the individual or entity accessing the Service.

2. Description of Service

PlateWeek is an AI-powered meal planning tool that helps users organize weekly meals, generate grocery lists, and discover recipes. The Service includes free and paid features. AI-generated content (meal suggestions, ingredient lists) is provided for convenience and may not be perfectly accurate. You are responsible for verifying nutritional information, allergen concerns, and dietary suitability.

3. Accounts

You may use some features of PlateWeek without an account. To save meal plans and access premium features, you must create an account through our authentication provider (Clerk).

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized access. We are not liable for losses arising from unauthorized use of your account.

4. Subscriptions & Payments

PlateWeek offers paid subscription plans processed through Polar.sh. By subscribing, you authorize recurring charges at the stated price and billing interval.

All sales are final. We do not offer refunds. The only exception is if the Service is materially non-functional (completely unusable) for a sustained period exceeding 7 consecutive days, in which case you may request a prorated refund for the affected period by contacting hi@weeklyplate.co.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until your billing period expires. No partial refunds are given for unused time.

We reserve the right to change pricing at any time. Price changes will take effect at the start of your next billing period. We will notify you of price changes at least 14 days in advance.

5. Acceptable Use

You agree NOT to:

  • Use the AI features for purposes unrelated to meal planning or food
  • Attempt to reverse-engineer, scrape, or extract data from the Service
  • Use automated tools, bots, or scripts to interact with the Service
  • Share, resell, or redistribute your account access
  • Submit harmful, illegal, or abusive content through the AI prompt
  • Attempt to circumvent payment requirements or access controls
  • Interfere with or disrupt the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

6. AI-Generated Content

PlateWeek uses artificial intelligence (via OpenAI) to generate meal suggestions, ingredient lists, and nutritional estimates.

AI-generated content is not medical, dietary, or nutritional advice. We make no guarantees regarding the accuracy, completeness, or suitability of AI suggestions. Always verify ingredients for allergens, cross-contamination risks, and dietary restrictions with qualified sources. We are not responsible for adverse reactions, health issues, or damages resulting from reliance on AI-generated content.

7. Service Availability & Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. This includes the right to shut down the Service entirely at our sole discretion.

We may perform maintenance, updates, or changes that temporarily affect availability. We will make reasonable efforts to notify users of planned extended downtime but are not obligated to do so.

We are not liable for any loss, damage, or inconvenience arising from the modification, suspension, or discontinuation of the Service.

8. Intellectual Property

The PlateWeek name, logo, design, and underlying code are our property or licensed to us. You retain ownership of your meal plan data. By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your account and access to the Service at any time, for any reason, with or without notice. Grounds for termination include but are not limited to violation of these Terms, abusive behavior, or fraudulent activity.

Upon termination, your right to use the Service ceases immediately. We are not obligated to provide your data after termination but may do so at our discretion upon request within 30 days.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email. Your continued use of PlateWeek after changes take effect constitutes acceptance. If you disagree with updated Terms, you must stop using the Service and cancel your subscription.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
